Pulp Addiction's Giveaway Promotion Terms and Conditions

TERMS AND CONDITIONS ("CONDITIONS OF ENTRY")

These terms and conditions are for all entrants who enter the "Pulp Addiction's Giveaway" Promotion (“Promotion”). Participation in this Promotion is deemed acceptance of these Terms and Conditions.

The “Promoter” is Pulp Addiction ABN 30 655 129 990, PO Box 288 Somerton VIC 3062.

ELIGIBILITY

This Promotion is only open to Australian and New Zealand residents currently living in Australia or New Zealand who are at least 18 years old.

The following persons are ineligible for the Promotion: (a) directors and employees of the Promoter, its related companies or any of its agencies or retailers that are associated with the Promotion; and (b) the spouse, defacto spouse, parent, child or sibling of an aforementioned excluded person.

PROMOTION PERIOD

The Promotion commences at 9.00am AEDT, Friday 6th February 2026 and closes at 11:59pm AEDT, Tuesday 31st March 2026. (“Promotion Period”)

HOW TO ENTER

To enter this Promotion, eligible individuals must:

1. Follow at least one of our official social media channels or subscribe to our newsletter during the Promotion Period:

2. Claim their free gift with their next order placed on Pulp Addiction website (www.pulpaddiction.com.au) within the Promotion Period or by 31st March 2026. Any unclaimed free gift after this time will be forfeited and is not redeemable. The free gift must be claimed in conjunction with an order and will not be sent separately.

It is a condition of entering the Promotion that entrants agree that their personal information to be added to the Promoter’s database and mailing list, their first name to be shared on our social media and newsletter, and to be used in accordance with the purposes set out in these Terms and Conditions;

LIMITS ON ENTRY AND FREE GIFT

Only one entry is permitted per person, subject to the following: (a) follow or subscribe to our Facebook, Instagram, YouTube channel or newsletter; and (b) only one (1) free gift is permitted per eligible entry per person. Multiple entries from the same person will be disqualified.

Entries are deemed to be received at the time and on the date that they are received by the Promoter.

FREE GIFT AND HOW TO CLAIM

The free gift is either one 80ml bottle of Diamine Mystery Ink* valued at RRP $21.95 or one MEMMO365 Luxe 2026 Diary (A5)* valued at RRP $32.00, with ink or diary colour chosen at random and while stocks last. Special request on the ink or diary colour is not permitted.

To claim the free gift, an eligible entrant must email Pulp Addiction Customer Service via Contact Us form and provide:

  • their social media account name or the email address used to subscribe to the newsletter; 

  • their existing order number; and

  • their choice of the free gift.

The free gift will be added to the entrant’s existing order and will only be sent with that order.

*The order and free gift must be placed and claimed by 11:59pm AEDT, Tuesday 31 March 2026. Any unclaimed free gift after this time will be forfeited and is not redeemable. The free gift must be claimed in conjunction with an order and will not be sent separately.

INVALID ENTRY

The following entries are not valid entries for the purpose of the Promotion: (a) entries placed outside promotion period; (b) multiple entries or claims from the same person; (c) claims for the free gift made outside the Promotion Period; (d) entries where the entrant did not follow or subscribe to at least one of our official channels or newsletter during the Promotion Period; (e) accounts that repeatedly unfollow or unsubscribe, then follow or subscribe again; and (f) entries where the identity of the entrant cannot be verified.

GENERAL

1. Promotion continues until end of promotion period.

2. Incomplete, indecipherable or illegible entries will be deemed invalid.

3. If there is a dispute as to the identity of the entrant, the Promoter reserves the right, in its sole and absolute discretion, to determine the identity of the entrant.

4. If for any reason an entrant does not take the gift at the time stipulated, then the gift will be forfeited.

5. If any gift (or part of any gift) is unavailable due to reasons beyond the control of the Promoter, the Promoter at its absolute discretion, reserves the right to substitute the gift (or that part of the gift) with a gift or store gift card to the equal value and/or specification.

6. Gift, or any unused portion of a gift, are not transferable or exchangeable and cannot be taken as cash or store gift card, unless otherwise specified. Tax implications may arise from the receipt or use of a gift. Independent financial advice should be sought.

7. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole and absolute discretion to the fullest extent permitted by law to: (a) disqualify an entrant; or (b) modify, suspend, terminate or cancel the Promotion, as it deems appropriate.

10. The Promoter’s decision is final, and no correspondence will be entered into in this regard.

11. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

12. Any gift that is not supplied by the Promoter (or its related companies) in the ordinary course of its business is, for the purposes of the Promotion, supplied to eligible entrants by the third party that directly supplies the goods or services. By entering the Promotion, each entrant acknowledges that: (a) the Promoter, its agents and contractors have no liability to entrants in respect of any loss, damage, cost, inconvenience or other disadvantage that may be suffered as a result of any defective or otherwise unsatisfactory goods or services supplied by a third party to a entrant, or the failure to supply those goods or services to a entrant; (b) it will not bring any claim against the Promoter, its agents or contractors in this respect.

13. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify, the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). 

14. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) the promotion; (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (c) any theft, fraud, online scam, unauthorised access or third party interference; (d) any entry or correspondence that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (e) any variation in the gift value to that stated in these Terms and Conditions; (f) any tax liability incurred by an entrant or claimant; or (g) use of the gift.

15. This promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, Mailchimp or YouTube.

PRIVACY

By entering this Promotion, each entrant consents to the personal information they submit with their entry being used for the primary purposes of: automatically signing up to our database, administering this Promotion, passing on information to related entities and to enter into a database for future promotional, marketing and publicity activities of the Promoter or its related entities. An entrant may request access to his or her personal information held by the Promoter by contacting the Promoter’s Privacy Officer. The Promoter may deny a request for access in some circumstances. An access fee may be charged to cover the Promoter’s costs of providing the information. The Promoter regards the security of personal information as a priority however the Promoter cannot guarantee the security of personal information provided.
